Author’s Note

My father always had the habit of saying that he would buy the Advocates’ Act someday, as it was the foremost legislation governing our profession. Hence, the day when he bought the Advocates’ Act, I looked up on the various e-commerce websites to find a commentary or a textbook for the same. However, I wasn’t able to find many. Only two to three were available. This made me very morose and angry, because I felt that the Advocates’ Act, which was the premier legislation for the legal fraternity, had been neglected terribly. The advocates, judges, jurists, as the case may be, were busy talking about the other legislations, even the legislations of other nations, but had forgotten their very own governing enactment. Hence, I took the voluminous task of writing a Section-wise, simplified commentary upon the Advocates’ Act. I have deliberately obliterated myself to add any Case Laws whatsoever (except 1). Because I feel that first we should know what is in the Act and only then try to look for any Case Laws. Even otherwise, this book is not a textbook, that it must contain Case Laws. This is a commentary, a ready reckoner of the Legislation stated. Moreover, this book is not just for the legal fraternity, but for anyone who wants to understand the Legislation governing our profession, how we function, how do we have to register ourselves, etc. Throughout the book, pictures have been added in order to relieve the eyes for some time and also, to break the stereotypical approach of writing law books without any pictorial representations whatsoever. Lastly, but not the least, I would like to say that this task ought to have been done by distinguished jurist, Justice, Judge, Advocate, or the like. But, due to the sheer ignorance given to this Legislation, an ungraduated 2nd year law student had to finish the same. Hence, irregularities may creep in. However, I have tried my level best to ensure that the same have been removed and the information provided has been made as much accurate as possible. Also, sometimes the reader may feel that the language of the commentary and that of the Legislation has overlapped. Well, for this I will have to express my sincere regards to the Parliament, which had made sure to draft the Act with utmost legislative simplicity, that it had become nearly impossible for me to simplify the provisions further, for some Sections. Yet, I have tried my level best to achieve the same.

Also, a copy of the Bare Act has been annexed with the commentary, so as to provide the readers with a better comparison.
